General:

Every purchase you make shall be deemed performed in the UK. UK law shall govern every aspect of contractual agreement concerning purchases made from Gemstone UK.

All the goods sold on this website or thereunder are sold without guarantee as to fitness for purpose and on the understanding that the Buyer will ensure that the goods are made safe and serviceable before re-sale.

The Buyer will indemnify the Seller from and against any claims whatsoever resulting directly or indirectly from the resale of Goods by the Buyer

No statement made by any person as to the quality or condition of any merchandise on offer is to relied upon for the purpose of making an offer to purchase.

The goods sold on this site are sold as 'trade sale' and as a customer purchasing via this site Buyer is not covered by legislation that protects 'non trade' consumers, this is regardless of the grade of parcel sold. All Goods are sold without any form of warranty or guarantee and full liability for any future issues with all Goods will sit with the Buyer not Gemstone UK. The Buyer is to ensure that they have read and understand all the terms and conditions and grades of stock PRIOR to you making a purchase, the Buyer will not be compensated if products develop a fault after resale by the Buyer to a third party or during future use by the Buyer.

No Order will be deemed to constitute a contract of sale irrespective of the manner of its transmission to the Seller until the Order has been dispatched by the Seller. We will confirm that the Order has been dispatched by a Dispatch Confirmation email. This confirmation email amounts to an acceptance by Gemstone UK of your offer to buy goods from us.

Import Duties:

If the Buyer’s delivery address is outside of the UK, you may be subject to import duties and taxes, which are levied once a shipment reaches the Buyer’s country. Any such additional charges for customs clearance must be borne by the Buyer. You should note that customs policies vary widely from country to country; Gemstone UK advises each customer to contact their local customs office for further information. Please note that when shipping products internationally, you should be aware that cross-border shipments are subject to opening and inspection by customs authorities.

Your Account:

The Buyer is responsible for all aspects of the account with us. Please keep your password safe and do not pass it on to any third parties. After creating your account, please ensure you receive your welcome email from us before placing an order with us.

Your Account Password:

You can amend any of your account information including your name, address, email address and password by selecting My Account after logging in. If you cannot remember your password you can request a password reset link to be sent to your registered email address by selecting Password forgotten? from the login page.

However, if you no longer have access to your registered email address and cannot login, please contact us so we can resolve this issue for you.

We reserve the right to remove your account if your registered email address becomes unavailable, if your business ceases trading or if your buying pattern falls below our minimum requirements.

Newsletter Subscription:

We aim to regularly email all subscribers to our newsletter. Subscription can be made when creating your account with us, or amended by selecting Subscribe or Unsubscribe from newsletters from My Account at the top of the page. To de-list from emailed Newsletters please select the unsubscribe link at the bottom of the emailed Newsletter.

Your Orders:

All orders placed with us can be viewed when you login to your account. You will be notified by email of order status updates and these can be also viewed when you login to your account.

Prices:

All prices are displayed and payable in British Pounds (GBP) and exclude VAT (value added tax) where applicable. For all UK customers, VAT is added at the checkout at the current rate. EU customers with a valid VAT number are exempt from VAT if the VAT number is completed in the user account registration details at time of registration. Those without a valid VAT number will be charged VAT at the current rate. All other customers are exempt from VAT. Some products are exempt from VAT such as books.

The price payable shall be that displayed at the time of ordering. Gemstone UK does not endorse nor in any way guarantee the credentials or accuracy of any currency conversion application available on our website. The information supplied by currency conversion applications are provided by third parties and should be used as a guide only.

Prices for our Goods and Services are subject to change without notice.
We reserve the right at any time to modify or discontinue the Goods or Service (or any part or content thereof) without notice at any time.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Goods or Service.

Special Offers, Bulk Purchases, Basket Discounts and Promo Codes:

Gemstone UK offers internet sales basket discounts, special offers and bulk purchase offers from time to time. These are automatically added to your order when checking out.

Bulk purchases are excluded from basket discount calculations. Where both a basket discount and a special promotional offer applies to an order only one discount will process, the higher of the two discounts will be applied.

To claim your promotional discount you must enter the appropriate promotional code (Promo Code) on the Your Cart webpage before entering the checkout:

Basket Discount codes will only be valid once your basket has reached the appropriate value.
Special Offer discount codes will only be valid once the product has been added to your cart.
Select the View Cart button from the Cart icon at the top of any webpage.
Enter the appropriate discount/promo code in the Discount Code box on the Your Cart webpage.
Select Apply Coupon.
Check that the Coupon Discount has been applied to your basket. Select Proceed to Checkout.
If you abandon checkout in order to add items to your cart, you will need to re-enter the Promo Code.

Promo Codes must be entered before checkout and payment. Only one discount or special offer can be entered per order. Discounts cannot be claimed after checkout.

Promotional discounts are no longer available on the Offer Ends date.

Postage Costs:

Postage costs are selected by the Buyer and added to the order when entering the Checkout.

Gemstone UK uses courier services for delivery and our delivery charges are in accordance with their standard rates (which are subject to change).

When entering the Checkout, please select the appropriate postage charge for your delivery address.

Free Shipping:

Free Shipping is offered to UK Mainland addresses only. Free Shipping will only be available to select once your basket has reached the appropriate promotional value.

When entering the Checkout, please select the Free Shipping option. Free Shipping cannot be claimed after checkout.

Payment:

Payment is due at the time of order. Goods remain the property of Gemstone UK until the order is accepted, dispatched and is fully paid for.

All payments are processed through our payment service provider Realex.

When the order is placed on our website your Credit/Debit card details are taken by Realex Payments, a payment gateway. We use Realex Payments to ensure we are PCI compliant and that your details are secure. Once you clear all of the security checks, we will confirm receipt of your payment by email. If there is any problem or if your payment is refunded / voided you will need to check with your card issuer to find out what the issue may be.

Delivery:

The Seller shall not be held liable for any losses, expenses or consequential loss incurred by the Buyer or any other person or company however arising whether directly or indirectly out of a failure of the Buyer to provide an accurate delivery address.

Missed Delivery:

Refunds Policy:

By using this website, you confirm that you are doing so in the course of business and not as a consumer and have authority to bind any business on whose behalf you use this website.
No returns will be accepted and no credit will be allowed for previously undiscovered defects or discrepancies in description. This does not affect any statutory rights that you may have to the extent that such rights are not excluded or limited under these terms and conditions.
The goods sold on this site are sold as ‘trade’ and as a customer purchasing via this site you are not covered by legislation that protects non trade consumers.

The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 do not apply.

Regardless of the classification of the stock parcel on sale, all Goods sold on this site are sold without any form of warranty or guarantee.
Full liability for any future issues with all Goods will sit with the Buyer from this site and not Gemstone UK. As a perspective Buyer you need to consider these facts before Buying and reflect this in any purchase that you make. Unless specifically covered by another term set out within these terms and conditions you will NOT be compensated if products develop a fault after resale by you to a third party or during future usage by you.

Colour Reproduction - Please note that we try our hardest to reproduce the colours of the Products. However, this is not always possible and the colours may differ slightly.

If you are unhappy with your Product when you received it please contact us within 48 hours of the day the Order was delivered (cooling off period), then we will gladly refund your money on receipt of the returned Product in accordance with our Returned Goods condition below.

We do not refund the postage or packing cost of returning any Product.

Faulty or damaged Products can be returned for a full refund or replacement at the discretion of the customer. We do not accept returned Compact Discs (CDs), Digital Versatile Discs (DVDs), audio or video products unless they are proved to be faulty. We will gladly replace any returned faulty CD.

A credit will be made to your account within 14 days of receipt of goods at Gemstone UK.

Returned Goods:

Notification of damage, of wrongly shipped Goods or incomplete shipped Goods must be made within 48 hours of delivery. Damaged goods and or packaging should be photographed and the photograph emailed to Gemstone UK. We strongly advise that you formally complain to the Courier at the time of delivery should you be presented with damaged packing. Details of all returned goods should be recorded via our Product Returns form. Any claim made outside of 14 days will not be accepted.

Returned Goods must be in resalable condition and in their original packaging. Seals should be intact where appropriate - for example cap seals on essential oil bottles.

The Buyer must obtain a proof of posting certificate (or country equivalent) from Royal Mail or equivalent postal service.

Returned Goods should be returned to us within 14 days of receipt of delivery. Any Goods returned after the 14-day period will be subject to a 30% restocking fee. No refunds will be issued for goods returned after 28 days. We must be able to resell goods in as new condition. Any goods where packaging has been damaged and therefore rendered un-resalable will not be refunded.

Damaged Returns:

The Buyer will be liable for the cost of remedying damage to returned Goods where such damage has in the opinion of the Seller been caused by the Goods being inadequately packaged by the Buyer.

Product Description Webpage:

Every Product offered for sale has a dedicated webpage. We aim to accurately describe every Product, accurately represent the Product with a representative photograph(s) and where possible a short 3D video on the Product webpage. Where a product page includes Dimensions (L W H) this describes the pack or bagged size of multiple items, or the size of an individual item. Average weights and sizes describe the average size of an individual item within a pack or bag. Please note that we try our hardest to represent the Product with accurate information.
We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any colour will be accurate.
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.
We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.
We aim to correct errors or omissions to Product description webpages when notified.

Warranty:

Crystals, minerals and fossils displayed for sale by Gemstone UK are sold as seen and can often be very delicate, brittle and contain natural flaws due to their inherent nature. Crystals, minerals and fossils may also alter colour or structure over time. Buyers should be aware of this when adding to their collections.

Other products sold by Gemstone UK are guaranteed against defects in material and workmanship for a period of one year. Please note we cannot accept responsibility for damage resulting from misuse.

The Gemstone UK’s failure to insist upon strict adherence to any of the terms and conditions with this contract shall not be deemed a waiver of its rights within these terms and conditions.

Product Reviews:

The Buyer grants Gemstone UK a non-exclusive, royalty-free worldwide license to use or edit any reviews posted by you. We reserve the right to publish, edit or remove any reviews without notifying you. We only edit reviews to correct spelling errors and only remove reviews which we deem to be offensive, libellous or in other ways break English laws.

Legal Liability:

The contracts from the sales of goods by Gemstone UK shall be subject to and governed by English law.

Liability of Gemstone UK shall in no circumstance exceed the original value of the price charged for the goods. Gemstone UK cannot accept liability for injury or negative consequence of using the products it sells.

Other than as expressly provided in these terms and conditions with respect to specific products and except for the exclusive remedies set out at, any indemnities, warranties, terms and conditions (whether express or implied) are hereby excluded to the fullest extent permitted under applicable law.

We will use reasonable endeavours to verify the accuracy of any information on the site but makes no representation or warranty of any kind express or implied statutory or otherwise regarding the contents or availability of the site or that it will be timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the website.

By placing an Order with Gemstone UK, the Buyer is agreeing to be bound by the Sellers terms and conditions.

This does not affect any statutory rights you may have as a trade or business customer.

Miscellaneous:

We shall have no liability to you for any delay in the delivery of products ordered or any other matters to the extent that the delay is due to any event outside our reasonable control, including but not limited to acts of God, war, flood, fire, labour disputes, strikes, lock-outs, riots, civil commotion, malicious damage, explosion, governmental actions and any other similar events.

We shall have no liability (including liability for negligence) for the acts or omissions of telecommunications service providers or for failures of, or faults in their networks and equipment.

No waiver by us of any breach of these Terms shall be considered as a waiver of any subsequent breach of the same or any other provision.

You may not permit, create unauthorized framing of, or deep linking to, this Site or the creation of derivative works thereof from any other website under your management or control.

In these Terms, Intellectual Property Rights means patents, database rights, copyright, design rights (whether registered or unregistered), trade marks (whether registered or unregistered) and other similar rights, together with the right to apply for the protection of any such rights. All Intellectual Property Rights in the Site shall be owned by us absolutely.

Subject to the licence granted to you to use the Site, Gemstone UK reserves all rights, title and interest in its Intellectual Property Rights in the Site. Any goodwill accruing from use of Gemstone UK trademarks, trade and business names and service marks under this Agreement will vest in Gemstone UK, as appropriate.

Anyone caught wilfully entering an erroneous or fictitious account or order will be prosecuted to the fullest extent of the law. Gemstone UK tracks the electronic fingerprints of every order placed on Gemstone UK to enable us and all legitimate crime prevention and prosecution authorities to trace individual users engaging in criminal activities on our website. We reserve the right to delete fictious accounts without notice.

Terms And Conditions Amendments:

Gemstone UK may amend these Terms from time to time, and place the new version on the Site. For users purchasing goods or registering on the Site for the first time, all purchases from the date that the amended terms are placed on our website onwards will be governed by those new terms. Otherwise, such changes will be effective against existing users thirty days following posting of the amended version on the Site. Your continued use of the Site following Gemstone UK posting of any changes will constitute your acceptance of such changes. Delivery Information

Please check our Terms and Conditions webpage before placing an order with us.

Postage costs are added to the order when entering the Checkout. When entering the Checkout, please select the appropriate postage charge for your delivery address. Charges would be determined by where you are geographically based and the total weight of the packed order.

We advise that you contact us to confirm charges if you have any questions prior to placing your order. If ordering from outside the EU please contact us so we can provide up to date shipping costs.

Once picked and packed orders will be despatched by courier for next day UK delivery excluding weekends. In circumstances outside our control, it may not be possible for delivery we would not be held responsible.

International delivery times may vary according to the destination countries customs regulations, see our Terms and Conditions.

Large packages weighing greater than 22 kg will be sent out in two or more boxes and would incur higher charges.

Delivery times may differ at holiday periods.
